These Terms & Conditions regulate the access and use of the online shop “STRÓ”, which uses Shopify software (https://www.shopify.com/), accessible at www.by-stro.com (hereinafter, the “Shop”), owned by  Mateus & Tavares, Lda, with legal seat at Travessa do Calado, N.º 26, B, 1170-070 Lisboa - Portugal (hereinafter, “Us”).

The Terms & Conditions are designed to define the rights and obligations of customers, as well as the rights, duties and responsibilities of the Shop.
The Shop reserves the right to update, change or replace any part of the Terms & Conditions and it is the responsibility of the customer to check this page periodically for any changes.

Please note that by visiting, using and purchasing on our Shop you agree to comply with the following Terms & Conditions:

You, the customer, agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website and/or of any of our Intellectual Property, including but not limited to our trade names, trademarks, designs and domain names, without express written permission from Us.

1.  ONLINE SHOP TERMS

By agreeing to these Terms & Conditions, the customer declares that they are of legal age. The customer may not use the products of the Shop for any illegal or unauthorized purpose nor may, through the use of the website, infringe any applicable laws (including but not limited to copyright laws).

2. PRODUCTS

STRÓ made every effort to display as accurately as possible the colours and images of the products that are sold at the Shop. The Shop cannot guarantee that the customer’s computer monitor displays of any colour will be accurate.

The Shop reserves the right to limit the sales of our products to any person who is not a consumer or who does not comply with these Terms and Conditions.

The descriptions, quality or characteristics of the products may be subject to change at any time without notice, at the sole discretion of the Shop. The Shop reserves the right to discontinue any product at any time.

3. ORDERS

You may buy our products at the Shop, using the website http://www.by-stro.com.

In order to place an order at the Shop, you must have an email account and a browser that allows the cookies in the Shop website, so that you can fully access and browse the Shop. The order is placed and processed in the following manner:

  • You browse the Shop and add the desired products to the basket;
  • You click “Proceed”;
  • You chose the payment method and click “Proceed”;
  • You review your order and finalize it by clicking “Check out”;
  • After placing an order, you receive an email confirming the order.

Your order is confirmed when you click “Check out” and an order number is generated.

We recommend that you save and/or print the confirmation email.

Order processing starts within 48 hours after the payment has been confirmed. Order processing takes, in average, 2-5 working days, except if the item is out of stock. If so, the customer will be contacted with the estimate delivery time.

Customer may change the order only until the order processing has been started i.e. within 48 hours from the time of the order placing. Customer can cancel the order within 24 hours from the time of the order placing by sending an email to: info@by-stro.com.

4. PRICES AND PAYMENT

All prices in the Shop are listed in Euros and include tax whenever applicable.

The price is valid from the time of the finalization of the order and it cannot be changed.

The prices of the products do not include any other costs or fees, such as customs, delivery, brokerage, etc, which may be added depending on the delivery method chosen by the customer, as per the shipping information.

Shop reserves the right to change the prices of the products, introduce new products to the Shop, carry out and cancel promotions at the Shop or modify its price and payment conditions at any time.

The Shop is not responsible for any customs, duty or brokerage fees that may occur when importing products into a different country than Portugal.

Customer can pay the products by debit or credit card and also by using the Shop’s "Gift Card", in which case the value of such order can only be equal to or higher than the value of the "Gift Card".

5. PROCESSING OF THE ORDER

 

The delivery method shall be selected by the customer and specified in the order.

Payment shall be made before processing of order is started.

Order will be processed provided that ordered products are available. In case of temporary lack of ordered goods, the order will be executed right after the product is made available, but no later than 30 days since the day of order and customer will be contacted with the estimate delivery time.

In case of any circumstances preventing the Shop from fulfilment of the order, for reasons beyond Shop’s control, the Shop shall immediately notify customer. In such case customer will have right to cancel the order.

6. DELIVERY ESTIMATED TIMES

All orders will be shipped with Proof of Postage and tracking number.

If your country is not referred in our list, please inquire for a quote of shipping costs and estimated delivery times to: info@by-stro.com.

It is customer’s responsibility to supply a daytime or commercial address to avoid missed deliveries. We don’t ship to PO Boxes.

Shipping to:

Portugal usually takes between 1 to 3 working days;

Europe usually takes between 3 to 7 working days;

Rest of the world usually takes between 7 to 21 working days.

However, bear in mind that other factors may alter these estimated delivery times and inevitably delay the arrival of the parcels, like weather conditions, health safety, political issues, shipping company issues and other extraordinary events.

Orders to ship outside of the European Union may have additional customs or import duty fees which we are unable to predict, as it depends on the destination country and are determined at arrival. Such fees or duties, and subsequent delivery delays, are of the exclusive responsibility of the customer.

7. RETURN POLICY

Customer has a right to return goods purchased in Shop for any reason within a maximum period of 15 days from the date of delivery, provided that:

  • The products have not been used or washed,
  • The products remain with their original characteristics (i.e., they have not been tampered with or in any way damaged);
  • The products are returned in the original package.

If the return occurs within the 15 day-period and the conditions identified in the preceding paragraph are met, Shop guarantees full refund of price.
Shipping and delivery costs are not refundable.

8. RETURN PROCEDURE

 To return a product to us simply follow these easy steps:

Contact us by email at info@by-stro.com. Include your name, address and the order number.

Pack all items with your invoice in their original packaging. Ensure that the packaging is secured, as we will not be able to make a refund for items damaged in return transit.

We are not liable for lost return parcels. Therefore, we recommend that you obtain a Registration/Proof of Posting in case the parcel fails to reach us.

Once received, we will inspect the goods within 3 working days and if their condition matches the requirements above referred, refund will be made within 15 working days. We will send you an email confirming your refund.

Please note that the return shipping costs will be covered by you.

9. COMPLAINTS POLICY

In case the delivered goods are defective or damaged, customer shall be entitled to return or replace the products.

Shipping costs of damaged goods are covered by the Shop.

All complaints are dealt within 14 days.

If the Shop finds no damage in the product or finds damages that are caused by use made by the costumer, the complaint is not accepted and the customer will be informed of the Shop’s conclusion. The Shop will send the product back to the customer at its own expense.

10. PRIVACY POLICY

The personal data collected by Us through the Shop concerns the name and contact details of the customer and also, if supplied, tax payer number and any other information that you may voluntarily supply to Us while using the Shop and in your contacts with Us.

The personal data is being collected and processed exclusively for the purpose of execution of orders, conducting promotional campaigns and marketing purposes, as well as for the compliance of applicable legal obligations and for legitimate interests (such as answering questions or providing other types of support to you, providing and improving our products and services, testing out features or additional services, assisting with marketing, advertising, or other communications).

Personal data is kept by Us for the period necessary for the purposes identified in the previous paragraph, including the applicable legal retention periods and for the exercise of any rights arising from the transactions executed in the Shop.

We share your personal data with:

  1. Shopify, the software used in the Shop - we recommend that you read Shopify's privacy policy, available at https://www.shopify.com/legal/privacy;
  2. Third party service providers, such as entities involved in the sales of our Products, namely, delivery and shipping entities;

iii. Official authorities, if and when legally ordered by those authorities.

By using Shopify, we may transfer your personal data outside the European Union.

As a data subject, you have the right to:

  1. Be informed of and access the data processing carried out by Us;
  2. Rectify and/or update your personal data;

iii. Erasure of your personal data;

  1. Restrict processing of your personal data;
  2. Object to the processing of your personal data;

You can also withdraw consent to data processing.

11. COOKIES

Because the Shop uses Shopify, we use cookies as per Shopify's cookie policy.

We recommend that you read Shopify's cookie policy, available at https://www.shopify.com/legal/cookies.

12. FINAL PROVISIONS

The Shop and the sales of products by the Shop are governed by Portuguese law.

Shop reserves the right to unilaterally amend Terms & Conditions at any time and without having to justify the cause.

In the event of changes in the Terms & Conditions after the placement of an order, customer is entitled to cancel the order. The changes do not apply to orders already shipped to customers.

Terms & Conditions come into force from the date of publication on the Shop’s website.
